Welcome to ShutterScape Studios. By accessing our website and utilizing our photography and videography services, you agree to be bound by the following terms and conditions (the "Terms"). 1. User Agreement

This User Agreement (the "Agreement") governs your use of the ShutterScape Studios website (the "Site") and our services (the "Services"). By accessing or using the Site or Services, you agree to be bound by this Agreement. If you do not agree to these Terms, please do not use the Site or Services.

1.1 Acceptance of Terms

Your access to and use of ShutterScape Studios is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site and Services.

2. Service Usage

2.1 Description of Services

ShutterScape Studios provides professional photography and videography services in Asheville, NC. These services include, but are not limited to: wedding photography, portrait photography, commercial videography, and real estate photography. 2.2 Booking and Scheduling

To book a session, please contact us through the Contact page or call us at (828) 555-0123. All bookings are subject to availability. A deposit may be required to secure your booking. The deposit amount and payment schedule will be communicated to you at the time of booking.

2.3 Cancellation and Rescheduling

Cancellations made more than 30 days prior to the scheduled session will receive a full refund of the deposit. Cancellations made between 14 and 30 days prior to the session will receive a 50% refund of the deposit. Cancellations made less than 14 days prior to the session will forfeit the entire deposit. Rescheduling is subject to availability and may incur additional fees. We understand that unforeseen circumstances may arise, and we will do our best to accommodate reasonable requests.

2.4 Client Responsibilities

Clients are responsible for obtaining all necessary permissions and consents for photography or videography at specific locations. Clients are also responsible for providing accurate and timely information regarding their needs and expectations. ShutterScape Studios is not responsible for any delays or issues arising from inaccurate or incomplete information provided by the client.

2.5 Payment Terms

Payment for services is due according to the payment schedule outlined in the booking agreement. We accept payments via credit card, check, and cash. Late payments may be subject to a late fee of 1.5% per month. For detailed pricing information, please visit our website or contact us directly.

3. Liability

3.1 Limitation of Liability

ShutterScape Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site or Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Site or Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site or Services by any third party; or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Site or Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not ShutterScape Studios has been advised of the possibility of such damages.

3.2 Indemnification

You agree to defend, indemnify, and hold harmless ShutterScape Studios, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Site or Services; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

3.3 Force Majeure

ShutterScape Studios shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

4. Copyright

4.1 Ownership of Content

All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of ShutterScape Studios or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content on the Site without the express written permission of ShutterScape Studios.

4.2 Usage Rights

ShutterScape Studios retains the copyright to all photographs and videos created during a session. Clients receive a license to use the images and videos for personal use, including printing and sharing on social media. Commercial use of the images and videos is prohibited without the express written permission of ShutterScape Studios. We reserve the right to use the images and videos for promotional purposes, including on our website and social media channels. If you prefer that we do not use your images for promotional purposes, please notify us in writing.

4.3 Copyright Infringement

ShutterScape Studios respects the intellectual property rights of others. If you believe that your copyright has been infringed, please contact us with the following information: (i) a description of the copyrighted work that you claim has been infringed; (ii) a description of where the material that you claim is infringing is located on the Site; (iii) your address, telephone number, and email address; (iv) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (v) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the state or federal courts located in Asheville, North Carolina, and you irrevocably consent to the jurisdiction of such courts in any such suit, action, or proceeding.
